Terms of Service

Welcome to GO. These Terms of Service ("Terms") govern your use of the GO smart card and profile platform operated by DigitalBits (Pty) Ltd ("DigitalBits", "we", "us", or "our").

By purchasing, activating, or using a GO card, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products or services.

1. Products and Services

GO is a physical NFC-enabled smart card that links to an online profile page you control. A single tap on a compatible smartphone opens your profile in the visitor's web browser.

You must be at least 18 years old to purchase or activate a GO card. By making a purchase or activating a card, you represent that you are of legal age to form a binding contract under South African law.

3. Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Payment must be made in full at the time of purchase. We accept payment via the methods displayed at checkout (including card payments via Yoco, instant EFT via Ozow, manual EFT, and PayFast).

Prices are quoted in South African Rand (ZAR) and include VAT where applicable.

4. Delivery

We offer delivery within South Africa. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by courier services or circumstances beyond our control.

Risk of loss passes to you upon delivery to the shipping address provided. Please ensure your delivery address is accurate and complete.

5. Use of GO

You agree to use GO only for its intended purpose — publishing a personal or business profile page accessible by tapping or scanning the card. You agree not to:

6. Device Requirements

The GO smart card requires a compatible NFC-enabled smartphone to function via tap. The card also carries a QR code as a fallback if NFC is unavailable. We recommend:

We are not responsible if GO does not work with a specific device due to incompatibility, disabled NFC, or operating-system restrictions.

7. Service Availability

While we strive to maintain continuous service, we do not guarantee that GO profile hosting, activation, or dashboard services will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the service at any time without notice.

The physical card itself remains your property and is not dependent on continuous service — only the hosted profile is.

8. Profile Retention and Archival

Your GO profile and its associated data — including published content, contact details, profile images, gallery uploads, social links, theme settings, short links, and tap analytics — are hosted live on our servers for a period of three hundred and sixty-five (365) calendar days from the date of card activation.

After 365 days of continuous service, profiles are automatically archived for security, data-hygiene, and POPIA-compliance purposes. Once archived:

You will receive a reminder email at least thirty (30) days before the scheduled archival date, advising you of that date and any options to renew or extend your hosting.

The physical card remains your property and is not affected by archival. Re-activation creates a fresh profile linked to the existing card UID; data from a prior archived profile cannot be restored once destroyed.

This retention policy supports our obligations under the Protection of Personal Information Act 4 of 2013 (POPIA), in particular Condition 5 (Information Quality) and section 14 (Records of Personal Information must not be retained for any period longer than is necessary for achieving the purpose for which the information was collected or subsequently processed).

9. Your Content and Data

You retain ownership of the content you upload to your profile (images, text, contact details). By uploading content you grant DigitalBits a non-exclusive, royalty-free licence to store, display, and transmit that content for the sole purpose of operating the GO service.

You are solely responsible for the legality, accuracy, and appropriateness of the content you publish.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Email addresses, phone numbers, and other personal data are encrypted at rest.

10. Intellectual Property

GO, the GO smart card design, the DigitalBits brand, all profile templates, and all related trademarks, logos, designs, and platform content are the property of DigitalBits (Pty) Ltd. You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by South African law:

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless DigitalBits (Pty) Ltd and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of GO, your published content, or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

14. Consumer Protection

Nothing in these Terms affects your statutory rights under the Consumer Protection Act 68 of 2008 (CPA), the Protection of Personal Information Act 4 of 2013 (POPIA), or any other applicable consumer protection legislation.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of GO after changes constitutes acceptance of the new Terms.
